沅陵縣深入“營(ying)業(ye)執照(zhao)剝離”改革(ge)的實質工(gong)作(zuo)💧的計劃

為深入貫徹落實《國(guo)務院(yuan)關(guไan)于深化“證照分(fen)離”改(gai)革(ge)進一步激發(fa)(fa)市(shi)場主體(ti)發(fa)(fa)展活力的通知(zhi)》(國(guo)發(fa)(fa)〔2021〕7號)、《湖(hu)(hu)南(nan)(nan)省(sheng)人民(min)政府辦公廳(ting)關(guan)于印發(fa)(fa)〈湖(hu)(hu)南(nan)(nan)省(sheng)深化“證照分(fen)離”改(gai)革(ge)實施方案〉的通知(zhi)》(湘政辦發(fa)(fa)〔2021〕45號)等(deng)文件要求,持續深化“放管服”改(gai)革(ge)優化營商環境,進一步激發(fa)(fa)市(shi)場主體(ti)發(fa)(fa)๊展活力,在(zai)全(quan)(quan)縣范(fan)圍內推(tui)行“證照分(fen)離”改(gai)革(ge)全(quan)(quan)覆蓋,結合我(wo)縣實際,制定本方案。

一、總的的要求

(一)具體指導意見觀念。以(yi)(yi)習近平總書(shu)記新時期(qi)的(de)中(zhong)國國家(jia)獨具(ju)特色社(she)會各(ge)界自由主義心理(li)為的(de)指導,完全(quan)(quan)認真落實黨(dang)的(de)19大(da)和(he)19屆二中(zhong)、四(si)中(zhong)、四(si)中(zhong)、五中(zhong)四(si)中(zhong)全꧋(quan)(quan)會心情(qing),以(yi)(yi)黨(dang)軍(jun)委(wei)、浙江省(sheng)(sheng)人民市(shi)政(zheng)施(shi)工府(fu)管理(li)部署安排和(he)省(sheng)(sheng)紀委(wei)省(sheng)(sheng)市(shi)政(zheng)施(shi)工府(fu)、市(shi)委(wei)市(shi)市(shi)政(zheng)施(shi)工府(fu)、縣委(wei)縣市(shi)政(zheng)施(shi)工府(fu)業(ye)務條件,加大(da)行政(zheng)訴(su)(su)訟(song)體(ti)制改(gai)變(bian)系(xi)(xi)統化(hua)(hua)集合、協同(tong)作戰更高(gao)效,繼(ji)續(xu)進(jin)(jin)(jin)一步“放(fang)管服”行政(zheng)訴(su)(su)訟(song)體(ti)制改(gai)變(bian),統等促進(jin)(jin)(jin)行政(zh🧔eng)訴(su)(su)訟(song)申批體(ti)系(xi)(xi)行政(zheng)訴(su)(su)訟(song)體(ti)制改(gai)變(bian)和(he)商事登記體(ti)系(xi)(xi)行政(zheng)訴(su)(su)訟(song)體(ti)制改(gai)變(bian),在挺大(da)標準和(he)多職(zhi)業(ye)進(jin)(jin)(jin)一步推動照后(hou)減證和(he)簡化(hua)(hua)法申批,企業(ye)創新和(he)加大(da)事中(zhong)當面(mian)管理(li),積極營造平衡、公正、白色、可預期(qi)收益的(de)市(shi)廠許可氛圍,幫助全(quan)(quan)市(shi)經(jing)濟增長優質化(hua)(hua)量(liang)進(jin)(jin)(jin)步。

(二)體制改革階段目標。在我區(qu)標(biao)準(zhun)(zhun)內快速方案(an)(an)涉企(含個人(ren)獨資工(gong)商所戶、種(zhong)植戶非常專(zhuan)業加盟社,一(yi)組詞)經(jing)營者允許(xu)議(yi)題(ti)全包裹明細(xi)清單表管控,是以直接的關(guan)閉批🤪復、批復設(she)成企業備案(an)(an)、全面(mian)實(shi)施(shi)書面(mian)通知約定(ding)、優化(hua)調(diao)整批準(zhun)(zhun)精準(zhun)(zhun)服(fu)務等四(si)種(zhong)問題(ti)的方式(shi)分級(ji)推廣批準(zhun)(zhun)管理(li)辦(ban)法改革方案(an)(an),再(zai)接再(zai)厲2022在年(nian)底前搭建(jian)極(ji)簡風格科學規范、公證處公證乳白色、寬進嚴(yan)管的行(xing)業中準(zhun)(zhun)營細(xi)則,下(xia)跌提升行(xing)業市(shi)場依據辦(ban)事人(ren)的便(bian)民度和可預(yu)期效果性。

二、積極帶動照后減證和簡單審核的

法律、行(xing)政法規(gui)、國務院(yuan)決(jue)定(ding)設(she)定(ding)(以(yi)下統稱中央(yang)層(ceng)面(mian)設(she)定(ding))的(de)涉(she)企經營許(xu)(xu)可事(shi)(shi)項(xiang),按照(zhao)《2021年(nian)湖南版(ban)中央(yang)層(ceng🅘)面(mian)設(she)定(ding)的(de)涉(she)企經營許(xu)(xu)可事(shi)(shi)項(xiang)改革(ge)清(qing)單(dan)(縣級改革(ge)事(shi)(shi)項(xiang))》(見(jian)🐼附件(jian)1),在全(quan)縣范(fan)圍內分類(lei)實施改革(ge)。地方(fang)層(ceng)面(mian)設(she)定(ding)的(de)涉(she)企經營許(xu)(xu)可事(shi)(shi)項(xiang),按照(zhao)《2021年(nian)版(ban)地方(fang)層(ceng)面(mian)設(she)定(ding)的(de)涉(she)企經營許(xu)(xu)可事(shi)(shi)項(xiang)改革(ge)清(qing)單(dan)(縣級改革(ge)事(shi)(shi)項(xiang))》(見(jian)附件(jian)2)執行(xing)。

(一)直接性注銷貸款審核。對“典當(dang)業(ye)(ye)特種(zhong)行(xing)業(ye)(ye)許(xu)可證(zheng)(zheng)核發(fa)”等(deng)審(shen)批層級為縣(xian)級的8項涉企(qi)經營許(xu)可事(shi💖)項直(zhi)接取消審(shen)批,行(xing)政審(shen)批部門一律不再受理(li)相關(guan)(guan)事(shi)項,不得以(yi)拆分(fen)、合并或(huo)(huo)重組等(deng)名義,條(tiao)目變相審(shen)批,不得轉移(yi)至行(xing)業(ye)(ye)協會(hui)、社會(hui)組織(zhi)變相保留,企(qi)業(ye)(ye)取得營業(ye)(ye)執(zhi)照(zhao)即可開展(zhan)經營,行(xing)政機關(guan)(guan)、企(qi)事(shi)業(ye)(ye)單(dan)(dan)位(wei)、行(xing)業(ye)(ye)組織(zhi)等(deng)不得要(yao)求(qiu)企(qi)業(ye)(ye)提供相關(guan)(guan)行(xing)政許(xu)可證(zheng)(zheng)件。在政府(fu)采(cai)購中(zhong),不得將企(qi)業(ye)(ye)取得或(huo)(huo)曾經取得相關(guan)(guan)許(xu)可證(zheng)(zheng)作為必(bi)要(yao)條(tiao)件或(huo)(huo)評分(fen)事(shi)項。(縣(xian)直(zhi)有關(guan)(guan)單(dan)(dan)位(wei)負責(ze))

(二)貸款審核換成備案表。對“機動(dong)車駕駛(shi)員培(pei)訓許可(ke)”等(deng)審(shen)批層(ceng)級(ji)為(wei)縣(xian)級(ji)的(de)5項涉企經營許可(ke)事(shi)(shi)項改為(wei)備(bei)案(an)(an)管理(li)。審(shen)批改為(wei)備(bei)案(an)(an)后,原則上實行事(shi)(shi)后備(bei)案(an)(an),企業(ye)取得營業(ye)執照(zhao)即可(ke)開(kai)展經營;確需事(shi🎐)(shi)前備(bei)案(an)(an)的(de),企業(ye)完成(cheng)備(bei)案(an)(an)手(shou)續即可(ke)開(kai)展經營。有關主管部門要(yao)抓緊建立(li)健全(quan)備(bei)案(an)(an)制(zhi)度,公布(bu)辦理(li)備(bei)案(an)(an)事(shi)(shi)項所需的(de)材(cai)料(liao),企業(ye)按規(gui)定提交(jiao)備(bei)案(an)(an)材(cai)料(liao)的(de),有關主管部門應當(dang)當(dang)場(chang)辦理(li)備(bei)案(an)(an)手(shou)續,不(bu)得作出不(bu)予備(bei)案(an)(an)的(de)決定。(縣(xian)直有關單(dan)位負責)

(三)進行 告知的保障。對“旅館業特種(zhong)行🐭業許(xu)可證核(he)發”等審批層級為縣級的29項涉企(qi)經(jing)營(ying)許(xu)可事項實行告知(zhi)承(cheng)(cheng)諾(nuo)。實行告知(zhi)承(cheng)(cheng)諾(nuo),有關(guan)(guan)主管(guan)部(bu)門要嚴格按(an)照《湖南省(sheng)(sheng)人民政府辦公廳關(guan)(guan)于印發<湖南省(sheng)(sheng)全面推行(xing)涉企(qi)(qi)經營(ying)許可(ke)(ke)(ke)事項告(gao)(gao)知(zhi)(zhi)承(cheng)(cheng)諾(nuo)(nuo)制實(shi)施方(fang)案>的(de)(de)通知🔴(zhi)(zhi)》(湘政辦發〔2021〕25號)要求(qiu)(qiu),科學編制告(gao)(gao)知(zhi)(zhi)承(cheng)(cheng)諾(nuo)(nuo)制工作(zuo)規(gui)程(cheng),依法(fa)列出可(ke)(ke)(ke)量化(hua)、可(ke)(ke)(ke)操(cao)作(zuo),不(bu)含(han)模糊(hu)表述和(he)兜底條(tiao)款的(de)(de)經營(ying)許可(ke)(ke)(ke)條(tiao)件,明確(que)監管(guan)規(gui)則和(he)違反承(cheng)(cheng)諾(nuo)(nuo)后(hou)果,一次性告(gao)(gao)知(zhi)(zhi)企(qi)(qi)業(ye),并(bing)提(ti)供告(gao)(gao)知(zhi)(zhi)承(cheng)(cheng)諾(nuo)(nuo)示范文本。對(dui)因企(qi)(qi)業(ye)承(cheng)(cheng)諾(nuo)(nuo)可(ke)(ke)(ke)以減省(sheng)(sheng)的(de)(de)審批(pi)材(cai)料(liao)(liao),不(bu)再要求(qiu)(qiu)企(qi)(qi)業(ye)提(ti)供;對(dui)可(ke)(ke)(ke)在企(qi)(qi)業(ye)領證后(hou)補(bu)交的(de)(de)審批(pi)材(cai)料(liao)(liao),實(shi)行(xing)容(rong)缺辦理(li)、限期補(bu)交。對(dui)企(qi)(qi)業(ye)自愿作(zuo)出承(cheng)(cheng)諾(nuo)(nuo)并(bing)按(an)要求(qiu)(qiu)提(ti)交材(cai)料(liao)(liao)的(de)(de),要當場作(zuo)出審批(pi)決定。針對(dui)實(shi)行(xing)告(gao)(gao)知(zhi)(zhi)承(cheng)(cheng)諾(nuo)(nuo)制的(de)(de)涉企(qi)(qi)經營(ying)許可(ke)(ke)(ke)事項清單,分類(lei)確(que)定核(he)查時間、標(biao)準(zhun)、方(fang)法(fa)以及是否免(mian)于核(he)查。(縣直有關(guan)(guan)單位(wei)負責)

(四)SEO核準的服務。對“勞務(wu)派遣經營(ying)許可(ke)”等(deng)審(shen)(shen)(shen)(shen)批(pi)(pi)層級(ji)為縣(xian)級(ji)以(yi)及改(gai)(gai)革(ge)后審(shen)(shen)(shen)(shen)批(pi)(pi)層級(ji)下放至縣(xian)級(ji)的(de)36項涉企(qi)經營(ying)許可(ke)事項實行(xing)優(you)化審(shen)(shen)(shen)(shen)批(pi)(pi)服務(wu)。對直接取(qu)(qu)消(xiao)審(shen)(shen)(shen)(shen)批(pi)(pi)、審(shen)(shen)(shen)(shen)批(pi)(pi)改(gai)(gai)為備(bei)案(an)、實行(xing)告知承諾以(yi)外的(de)其他涉企(qi)經營(ying)許可(ke)事項,有(you)關(guan)主管部門要(yao)按照“一(yi)(yi)(yi)件事一(yi)(yi)(yi)次辦”改(gai)(gai)革(ge)要(yao)求,綜合運(yun)用下放審(shen)(shen)(shen)(shen)批(pi)(pi)權限(xian)、精簡許可(ke)條件、簡化審(shen)(shen)(shen)(shen)批(pi)(pi)材料(liao)、優(you)化審(shen)(shen)(shen)(shen)批(pi)(pi)流程、壓縮審(shen)(shen💙)(shen)(shen)批(pi)(pi)時(shi)間、延(yan)長或取(qu)(qu)消(xiao)許可(ke)期限(xian),以(yi)及取(qu)(qu)消(xiao)或放寬審(shen)(shen)(shen)(shen)批(pi)(pi)數量(liang)限(xian)制(zhi)并定期公(gong)布總量(liang)控制(zhi)條件、企(qi)業存(cun)量(liang)、申請排(pai)序(xu)情況等(deng)方式,進(jin)一(yi)(yi)(yi)步優(you)化審(shen)(shen)(shen)(shen)批(pi)(pi)服務(wu),提(ti)高審(shen)(shen)(shen)(shen)批(pi)(pi)效率,鼓勵企(qi)業有(you)序(xu)競爭。(縣(xian)直有(you)關(guan)單位(wei)負責(ze))

三、升級改善體(ti)系集成化和(he)協同作戰設(she)備配套

(一)廢除涉企經營標準化管理許可證情況說明菜單標準化管理。按照“證照分離”改革全(quan)覆蓋工(gong)作要(yao)求,將審(shen)(shen)批層(ceng)級為縣(xia𒀰n)(xian)(xian)級的中央和地方層(ceng)面設(she)定(ding)的涉企(qi)經(jing)營(ying)許可事項全(quan)部(bu)納入(ru)我(wo)縣(xian)(xian)(xian)涉企(qi)經(jing)營(ying)許可事項清(qing)單(dan),縣(xian)(xian)(xian)審(shen)(shen)改辦(ban)要(yao)建立(li)健全(quan)清(qing)單(dan)管理制度,動(dong)態(tai)調整更(geng)新清(qing)單(dan),及時(shi)通(tong)過縣(xian)(xian)(xian)政府門戶(hu)網(wang)站和一體化(hua)政務(wu)服務(wu)平臺向社會公布,接(jie)受(shou)社會監督。縣(xian)(xian)(xian)直各有(you)關(guan)部(bu)門要(yao)逐項認領和嚴格執行(xing)清(qing)單(dan)中的事項,2021年年底前(qian)對(dui)清(qing)單(dan)之(zhi)外限(xian)(xian)制企(qi)業進入(ru)特定(ding)行(xing)業開(kai)展經(jing)營(ying)的管理事項進行(xing)全(quan)面自查清(qing)理。清(qing)單(dan)之(zhi)外,一律不得限(xian)(xian)制企(qi)業進入(ru)相關(guan)行(xing)業開(kai)展經(jing)營(ying)。(縣(xian)(xian)(xian)政務(wu)中心、縣(xian)(xian)(xian)市場監管局牽頭,縣(xian)(xian)(xian)直有(you)關(guan)單(dan)位負責)
